When you buy a product or service, you have the right to expect it to meet certain standards. If you receive something faulty or the service is poor, you can take action. The Consumer Protection Act of 1986 empowers consumers with legal rights and protections. This Act allows you to file a formal complaint, known as an online consumer complaint, against a business or service provider if they haven't addressed the issue. Complaints are typically filed after a business fails to resolve the problem despite a clear request. When submitting a complaint, be sure to include all relevant details and any supporting documentation. Consumer courts in India offer consumers efficient legal recourse and judgments.
The first step is to clearly explain the problem you faced with the product or service in writing to the manufacturer or seller. For claims exceeding ₹10,000, consulting a lawyer is highly recommended. A lawyer can deliver a formal notice on your behalf, demonstrating your intent to pursue legal action if necessary.
After sending the notice, the company might respond and offer a solution. Keep in mind that courts may not award excessively high compensation. If you don't receive a response within the given timeframe (usually 15 days), you can proceed to the consumer forum.
Select the appropriate consumer forum based on the claim amount and desired compensation. You or a representative can file a complaint with the district forum, state commission, or national commission. Be prepared for the process to take anywhere from six to eighteen months.
